MY FM ICON CONTEST
CONDITIONS OF ENTRY


The following Special Condition of Entry (hereinafter referred to as Special Rules) apply for MY FM Icon Contest (hereinafter referred to as the Contest) on MY FM (hereinafter referred to as the Radio Station).

Registration for the Contest will commence 26th May 2008 until 29th June 2008.
The Special Rule will apply in conjunction with MY FM's General Contest Rules. Where there is inconsistency, the Special Rules will prevail. Both these terms and conditions and MY FM's General Contest Rules can be downloaded from the website at http://www.my.com.my.

    * 1.METHOD OF ENTRY

To register as a Contestant, listeners will be invited to register via MY FM's website (www.my.com.my) and submit their original artwork/designs for the MY FM Icon.

    * 2.DURATION OF THE PROMOTION

Registration for the Contest will commence 26th May 2008 until 29th June 2008. After Registration the Radio Station will short list 10 contestants and their designs. These designs will then be uploaded onto the MY FM website. Listeners will then be invited to vote via SMS which artwork/design they like best. Duration for voting is from 30th June 2008 to 27th July 2008.

    * 3.NATURE AND VALUE OF THE PRIZE (S)

The Winner's artwork/design will become MY FM's Official Icon. The Winner of the Contest will also win a variety of prizes as listed below:-

    * Become MY FM's Important Person (MIP)
    * Receive free movie passes distributed by the Radio Station
    * Receive free local concert tickets held by the Radio Station
    * Receive RM10,000 cash


The prizes shall be valid for 6 months only commencing from 1st August 2008 - 31st January 2009.

    * 4.CONTEST MECHANICS

The Radio Station is looking for an ICON to represent the Radio Station's image and values. Contestants will be required to create an original artwork/design that they think best represent the Radio Station.

Submissions of the design must be made via the Website www.my.com.my between 26th May 2008 until 29th June 2008. Submissions must be in jpeg file and must be clear. Any submissions that are unclear or cannot be opened shall be disqualified.

The design / artwork must reflect the station's brand values which are Trendy, Vibrant, Humorous, Celebrity, Relatable and Young.

10 designs will be short listed by the Radio Station and listeners shall vote for the best design via SMS. The Winner's artwork/design will become MY FM's Official Icon and copyright of the design shall belong to the Radio Station.

    * 5.SPECIAL CONDITIONS

5.1 Contestants of all ages may enter this Contest. Contestants under the age of 18 years old must have parental / guardian approval to enter this Contest.

5.2 Malaysian Citizen or Malaysian Permanent Resident;

5.3 Any Contestants who behave in a manner, which is unfair to the other Contestants or to the public at large will be disqualified. The decision of the Radio Station is absolute and final. Appeals will not be entertained.All disqualifications and decisions pertaining to Contestants will be decided by the Radio Station Programme Manager and/or the Radio Station'sSeniorMarketing & Promotions Manager only.

5.4 Contestants are not permitted to do anything which might degrade the announcers or the Radio Station for the duration of the Contests.

5.5 Contestants may be required to conduct live on-air crosses / interviews with the Radio Station announcers or ground personnel at anytime throughout the duration of the Contest.

5.6 All Contestants must obtain prior written consent of the Radio Station before participating in any commercial or non-commercial activities / advertisements / interviews / promotions in connection with the Contest in any media other media other than the Radio Station. Failure to do so may result in disqualification.

5.7 The Winner of the Contest shall make himself/herself available to the Radio Station for on-ground activities, interviews, promotions and any other event as required by the Radio Station.

5.7 The Radio Station reserves the right to discontinue, add to or alter these rules at any time upon notice to the Contestants.

    * 6.USE OF PHOTOS, FILM FOOTAGE, INTERNET

All Contestants acknowledge that it is a condition of entry that the Radio Station have the right to publicise their names, designs, characters, likenesses or voices of any of the contestants for any promotional or matter incidental to the Contest, including publication by way of radio broadcast, television program/broadcast, internet or any other medium at the absolute discretion of the Radio Station.

The Winner may also be required by the Radio Station to participate in a photo, video and/or film session and acknowledges that the Radio Station has the right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it sees fit

Contestants also acknowledge that their photo/video footage may be used for any promotional display at any Ford's location and/or other locations chosen by the Radio Station.

It is a condition of entry that the contestants consent to being filmed or videotaped by any party authorised by the Radio Station and that the resulting videotape or film or any part thereof may be used by the Radio Station or a party authorised by the Radio Station for unlimited purposes including the promotion of this competition or any television program.

Each Contestant acknowledges that all photos, sound recordings, film, video, radio broadcasts, television broadcasts, material appearing on the Radio Stations website and any other material created by the Radio Station or its authorised representatives in relation to the promotion (the material) is the sole and exclusive property of the Radio Station or its authorised parties and is protected by copyright and trade mark laws.

The Contestants must not use, copy, reproduce, publish, modify, adapt, transmit, communicate to the public, broadcast, re-broadcast, make a sound recording of or distribute the material in any way unless expressly authorised in writing by the Radio Station. Each Contestant indemnifies the Radio Station and their related corporations against all expenses, losses, damages and costs that the Radio Station or their related corporations may sustain or incur as a result, whether directly or indirectly, of any breach of the terms and conditions by the Contestant

    * 7.INTELLECTUAL PROPERTY

The Contestants assign to MY FM all present and future copyright and any other rights in relation to the artwork/design submitted for this Contest and the product of the entry the Contestants made under this Contest throughout the world and perpetuity;

The Contestants understand and agree that all rights in and to the entries and this Contest belong unequivocally to MY FM and MY FM reserves the right to use, edit, modify, reproduce, distribute and otherwise exploit the artwork/design of the Contest (whole or in part) in all media (without limitation to print, radio, television, internet, multimedia and other media hereinafter invented) worldwide and in perpetuity;

The Contestants consent to the exploitation of the artwork/design any part(s) thereof (including the film and/or sound recordings) by all means and in all media and formats, whether now known or hereafter invented, worldwide and in perpetuity;

MY FM and its affiliates shall have full charge of and control of the manner in which and the manner on which the artwork/design shall be marketed, used, distributed, exploited, exhibited and/or otherwise disposed of throughout the world.

    * 8.INDEMNITY

All Contestants release from, and indemnify the Radio Station and Airtime Management & Programming Sdn Bhd (hereinafter referred to as AMP), its respective employees, officers, directors, agents, affiliates, parent, subsidiaries, representatives and its advertising agencies from and against any liabilities, suits, claims, demands, costs or expenses including attorney fees, arising out of or in any way related to participation in the Contest and the winner's receipt or use of this prize.

The Contestants release from and indemnify the radio Station, AMP against all liability, cost loss or expense arising out of acceptance of any prize(s) or participation in the Contest including (but not limited to) personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

Contestants must sign a general release of all claims in order to participate in this Contest.
Participants waive any and all claims of liability against the Radio Station and AMP, its respective employees, officers, directors, agents, affiliates, parent, subsidiaries, representatives and its advertising agencies from any accident, loss and/or injury occurring as a result or consequence of this contest.

9.CONFIDENTIALITY
All Contestants accept that certain elements of the Contest and promotions must remain confidential and not be discussed with anyone other than the Radio Stations personnel unless permission is given by the Radio Station. This includes friends, family, members of the media and on-air with the radio Stations Announcers

Contestants must not at any time (either during or after the promotion) for any reason divulge any trade secret, confidential information, programming or promotional or other information of the Radio Station or any related body corporate to any other person or company.

In this clause Confidential Information means all information relating to the Contest promotion which is not generally known to persons outside the radio Station. The Contestants must on demand return to the Radio Stations any documents supplied to the Contestants in connection with the promotion.

10.Prizes are non-transferable, must be used on the dates specified and are not redeemable for cash.

11.Winners will be responsible for any and all taxes incurred in relation to their receipt of the prize(s)/ purchases. Winners will also be responsible for any and all costs incurred from the collection, transportation and installation of the prize(s)/ purchases.

12.Employees and their immediate families of the Radio Station, AMP, its respective employees, immediate family members, officers, directors, agents, affiliates, parent, subsidiaries, representatives and its advertising agencies are not eligible to participate in this promotion.

13.The Radio Station and AMP will not be responsible or liable if for any reason beyond their reasonable control any element of any prize is not provided and may at its absolute discretion substitute a different prize in place of any prize referred to in these terms and conditions.

14.All Winners must sign these Special Terms, deed of acknowledgement, indemnity form and General Terms in a form prescribed by the 15.Radio Station or AMP in order to receive their prize or participate in this promotion.

15.The Radio Station may terminate this competition at any time at its absolute discretion without liability to any contestant or other person.

16.In all matters, all decisions of the Radio Station's personnel will be final and cannot be contested. No correspondence or discussions will be entertained.

    * 17.NOTIFICATION
      The promoter is Airtime Management & Programming Sdn Bhd, All Asia Broadcast Centre, Technology Park Malaysia, Lebuhraya Puchong Sg Besi, Bukit Jalil, 57000 Kuala Lumpur.
